MINUTES
MAYOR AND BOARD OF ALDERMEN
CITY OF OCEAN SPRINGS
RECESS MEETING OF NOVEMBER 17, 2009
Be it remembered that the Mayor and Board of Aldermen of the City of Ocean Springs met in a Recess meeting at City Hall in the City of Ocean Springs at 6:00 p.m. on November 17, 2009. Mayor Moran presiding, Aldermen Ross, Gill, McDonnell, Cody, Denyer, Dalgo and Hagan were present. Also present were City Clerk Shelly Ferguson and City Attorney John Edwards.
Alderman Cody gave the invocation and the Mayor led the Pledge of Allegiance.
Motion was made by Alderman Denyer, seconded by Alderman Cody, and unanimously carried to table item (5-a) and remove item (5-c) from the agenda.
Motion was made by Alderman Denyer, seconded by Alderman Cody and unanimously carried to add an Old Business item – update Public Safety Center
presented by Henry Furr.
Motion was made by Alderman Hagan, seconded by Alderman Cody and unanimously carried to add an addendum to the agenda.
PRESENTATION
Jackie McIntosh and Villa Maria residents presented Chief Lionel Cothern with handmade Bears for police officers to keep in their vehicles to give to children.
OLD BUSINESS
Motion was made by Alderman Denyer, seconded by Alderman Gill and unanimously carried to declare that local emergency regarding Tropical Storm Ida ceased at 12:00 p.m. on Nov. 10, 2009.
Alderman Denyer gave an update on the Front Beach Sidewalk engineering and construction.
Update on Public Safety Center by Henry Furr moved to executive session.
PUBLIC HEARINGS
Motion was made by Alderman McDonnell, seconded by Alderman Ross to enter public hearing (5-b) 421 Woody Circle. Building Official Terry Agar presented
photos and description of property. Motion was made by Alderman Cody, seconded by Alderman Ross and unanimously carried to exit public hearing. Motion was made by Alderman Cody, seconded by Alderman Gill to declare the residence at 421 Woody Circle to be a menace to the public health and safety with Alderman Gill, McDonnell, Cody, Ross, Denyer, and Hagan voting aye, Alderman Dalgo voting nay. Motion was made by Alderman Cody, seconded by Alderman Gill to proceed with lot cleaning at 421 Woody Circle with Alderman Gill, McDonnell, Cody, Ross, Denyer and Hagan voting aye, and Alderman Dalgo voting nay. Motion was made by Alderman McDonnell, seconded by Alderman Cody and unanimously carried to submit photos presented by Building Official Terry Agar to the minutes.
Motion was made by Alderman McDonnell, seconded by Alderman Hagan to enter public hearing (5-d) 1305 Cove Ave. Building Official Terry Agar presented photos and description of property. Attorney Earl Denham spoke on behalf of Henry and June Kuehn. Mr. Denham provided a copy of the pending lawsuit with State Farm Insurance regarding the property. Motion was made by Alderman McDonnell, seconded by Alderman Cody and unanimously carried to exit Public Hearing. Motion was made by Alderman McDonnell, seconded by Alderman Cody to board up residence, mow lawn on regular basis, and secure residence. Alderman McDonnell rescinded his motion. Motion was made by Alderman McDonnell, seconded by Alderman Denyer and unanimously carried to table Item 5-d Lot Cleaning Hearing until December 15, 2009 Mayor and Board of Alderman meeting.
PUBLIC COMMENT
No public comments
CONSENT AGENDA
Motion was made by Alderman Hagan, seconded by Alderman McDonnell and unanimously carried to approve Item 1-ab and 1-ac.
Motion was made by Alderman Denyer, seconded by Alderman Hagan and unanimously carried to approve the Consent Agenda with the exception of item (p).
Item (p) was removed from the agenda.
DEPARTMENT REPORTS
No department reports presented
ALDERMEN’S FORUM
Motion was made by Alderman Dalgo, seconded by Alderman Hagan and unanimously carried to authorize up to $500.00 from Ward 5 Capital Improvement Account for Magnolia Bayou Homeowner’s Association landscaping.
Alderman Cody requested the Mayor to seek volunteers to assist in property clean up in his ward.
Alderman Gill requested the Mayor to contact MDOT regarding the pedestrian walkway at Ft. Bayou Estates and pole that was damaged by a vehicle, the intersection of Hwy 90 in front of the Winn Dixie Shopping Center and the west side traffic signal at Hanshaw Road and Hwy 90.
Alderman Denyer requested an update on traffic light synchronization and additional lighting request at Alice St. Park.
EXECUTIVE SESSION
Motion was made by Alderman Cody, seconded by Alderman Hagan and unanimously carried to go into closed session to determine the necessity of going into executive session.
The City Clerk returned to the meeting and announced that a motion was made by Alderman McDonnell, seconded by Alderman Cody and unanimously carried to remain in executive session to enter strategy session regarding the lowest and best bidders on the Public Safety Center Complex and whether or not the City can negotiate of the same, which may result in an appealable decision.
Alderman Dalgo leaves meeting at 7:30 p.m.
Alderman Gill leaves meeting at 7:30 p.m.
Motion was made by Alderman McDonnell, seconded by Alderman Hagan and unanimously carried to come out of executive session and return to regular session.
Motion was made by Alderman McDonnell, seconded by Alderman Ross and unanimously carried to adjourn until 6:00 p.m. on December 1, 2009.
Meeting ended at 8:30 p.m.
