MAYOR AND BOARD OF ALDERMEN
CITY OF OCEAN SPRINGS
SPECIAL CALL MEETING OF DECEMBER 21, 2009
Be it remembered that the Mayor and Board of Aldermen of the City of Ocean Springs met in a Special Call meeting at City Hall in the City of Ocean Springs at 5:30 p.m. on December 21, 2009. Mayor Moran presiding, Aldermen Ross, McDonnell, Cody, Denyer and Dalgo were present. Also present were City Clerk Shelly Ferguson and City Attorney John Edwards. Aldermen Gill and Hagan were absent.
The Mayor called the meeting to order.
The Special Call Meeting is for the purpose of any and all matters pertaining to the December 15, 2009 ruling of the Court of Appeals, we move to rescind the prior order of the board contained in Exhibit “5-f”, as the conditions contained therein were contrary to law and therefore, to adopt simply the portion of the board’s finding that the proposal before the board was interpreted as a permitted use as contained in Exhibit “A”.
EXECUTIVE SESSION
Motion was made by Alderman McDonnell, seconded by Alderman Denyer and unanimously carried to go into closed session to determine the necessity of going into executive session.
The City Clerk returned to the meeting and announced that a motion was made by Alderman McDonnell, seconded by Alderman Denyer and unanimously carried to remain in executive session to discuss litigation regarding the Court of Appeals.
Alderman Gill arrives at the meeting at 5:45 p.m.
Motion was made by Alderman Denyer, seconded by Alderman Gill and unanimously carried to come out of executive session and return to regular session.
Motion was made by Alderman McDonnell, seconded by Alderman Ross and unanimously carried to adjourn the special call meeting.
Meeting ended at 5:54 p.m.
