    Minutes - September 4, 2018 - 6:00 p.m. Regular Meeting

    REGULAR MEETING OF SEPTEMBER 4, 2018

    Be it remembered that the Mayor and Board of Aldermen of the City of Ocean Springs met in a Regular meeting at City Hall in the City of Ocean Springs at 6:00 p.m. on September 4, 2018.  The Mayor presiding, Aldermen Cox, Gill, Papania, Blackman, and Impey were present.  Also present was Interim City Clerk Patty Gaston and City Attorney Kevin Melchi. Aldermen Authement and Bellman were absent.                  

    The Mayor called the meeting to order.

    Alderman Papania gave the invocation and the Mayor led the Pledge of Allegiance.

    PRESENTATION

    The presentation from Mr. Leonard Bentz regarding various programs provided by South Mississippi Planning and Development District was rescheduled due to the pending landfall of Tropical Storm Gordon. (Exhibit 3-a)

    OLD BUSINESS

    Motion made by Alderman Blackman, seconded by Alderman Cox and unanimously carried to adopt the Resolution of the City of Ocean Springs, Mississippi to Match Donated Funds to the Walter Anderson Museum of Art.  (Exhibit 4-a)

    ADDENDUM

    Motion made by Alderman Cox, seconded by Alderman Gill and unanimously carried to add the Addendum to the Agenda. 

    CONSENT AGENDA

    Motion made by Alderman Blackman, seconded by Alderman Cox and unanimously carried to approve the Consent Agenda with the exception of items (p) pulled by Alderman Papania, (r) pulled by Alderman Gill, and (t) pulled by Alderman Impey.

    Alderman Gill pulled item (r) to discuss the denial of a request to remove (2) two cypress trees at 3807 Queen Elizabeth Drive.  The Tree Committee approved removing one of the cypress trees but denied the second one.  Alderman Gill stated he has gone by this property and looked at the cypress tree that was denied for removal.  Alderman Gill said this tree is in the sprinkler system and has gone underneath the neighbor’s driveway.  He stated it will only be a matter of time before it causes damage to the sprinkler system and driveway. 

    Motion made by Alderman Gill, seconded by Alderman Blackman and unanimously carried to approve the Tree Protection Committee Meeting Minutes from August 28, 2018. (Exhibit 6-r)

    Motion made by Alderman Gill, seconded by Alderman Cox and unanimously carried to overturn the Tree Committees decision and allow the second cypress tree located at 3807 Queen Elizabeth Drive be removed.

    Alderman Papania pulled item (p) to request to table this item until more questions can be answered and Alderman Bellman can be present since this property is located in his ward.

    Motion made by Alderman Papania, seconded by Alderman Cox and unanimously carried to table item (p) requesting approval for License to Encroach for Driveway within Undeveloped Joyce Street Right-of-Way, Lot 12 Davidson Subdivision.  (Exhibit 6-p)

    Alderman Impey pulled item (6-t) from the agenda for a discussion on a variance reduction request from the Ocean Springs School District and to recuse himself from any voting that may take place.

    Alderman Blackman said the City has received preliminary plans for the Ocean Spring Stadium.  The Ocean Springs School District is asking for a little more than a 50% reduction from the code requirements for fixture count in the women’s restroom.  The code states they should have (34) thirty-four total water closets and they are asking to reduce this number to (15) fifteen.  Alderman Blackman believes reducing the count by this much is excessive. Alderman Blackman said we should request they add (3) three more stalls to put them at (18) eighteen.

    The City Attorney stated the Ocean Springs School District needs to resubmit the plans to the Building Department and start the process over.  Once that has been done the Building Official can then make a recommendation and bring it back to the Board for consideration. 

    NEW BUSINESS

    Motion made by Alderman Impey, seconded by Alderman Blackman and unanimously carried to ratify the Proclamation of Existence of a Local Emergency by the Mayor and Board of Aldermen of the City of Ocean Springs, Mississippi for Tropical Storm Gordon. (Exhibit A-1a)

    DEPARTMENT REPORTS

    City Clerk:

    Motion made by Alderman Impey, seconded by Alderman Cox and unanimously carried to approve the docket of claims and spread summary upon the minutes. (Exhibit 7-a)

    ALDERMEN’S FORUM

    Alderman Gill asked about the application for tree removal at 3615 Portree Place.  Alderman Gill said this request is confusing on what exactly they are asking for.

    Motion made by Alderman Gill, seconded by Alderman Blackman and unanimously carried to send the request for tree removal at 3615 Portree Place back to the Building Department for rescheduling.

    Alderman Blackman thanked all the departments for being out in the storm when everyone else is safe at home.

    EXECUTIVE SESSION

    The executive session item to discuss potential litigation regarding boat on Fort Bayou has put on hold for now.

    Motion was made by Alderman Cox, seconded by Alderman Blackman and unanimously carried to recess until 6:00 p.m. on September 18, 2018.

    The meeting ended at 6:22 p.m.
