    Minutes - April 4, 2017 - 6:00 p.m. Regular Meeting

    REGULAR MEETING OF APRIL 4, 2017

    Be it remembered that the Mayor and Board of Aldermen of the City of Ocean Springs met in a Regular meeting at City Hall in the City of Ocean Springs at 6:00 p.m. on April 4, 2017.  The Mayor presiding, Aldermen Cox, Gill, Cody, and Impey were present.  Also present was City Clerk Shelly Ferguson and City Attorney Kevin Melchi. Aldermen, McDonnell, Denyer, and Dalgo were absent.                    

    The Mayor called the meeting to order.

    Alderman Chic Cody gave the invocation and the Mayor led the Pledge of Allegiance.

    ADDENDUM

    Motion made by Alderman Cody, seconded by Alderman Gill and unanimously carried to add the addendum to the agenda.

    PROCLAMATIONS

    The Mayor read a proclamation proclaiming April 2017 as Child Abuse Prevention Month and presented it to the South Mississippi Child Advocacy Center. (Exhibit 3-a)

    The Mayor read a proclamation for The Fifth-Annual Mayor and County Recognition Day for National Service on Tuesday,April 4, 2017, and encouraged residents to recognize the positive impact of national service in our community and thank those who serve and presented it to Alice Fairley. (Exhibit 3-b)

    The Mayor proclaimed Thursday, April 6, 2017 as National Walking Day. (Exhibit 3-c)

    The Mayor read a proclamation declaring April 2017 as Safe Digging Month and presented it to James Foster, Interim Public Works Director. (Exhibit 3-d)

    NEW BUSINESS

    Motion made by Alderman Gill, seconded by Alderman Cody to authorize to approve the Ordinance Modification to extend the approved Porter Avenue Arts & Entertainment District as described in the attached documents. Motion passed. (Exhibit 4-a)

    Alderman Cody discussed the Mississippi Power proposal for first phase of the outdoor LED lighting conversion in Ward 3.  Alderman Cody said there was a study done in Ward 2 which carries over into Ward 3.  He stated the lighting will be brighter making it safer for jogging, biking, and walking.  This proposal does not cover all of Ward 3.  Alderman Cody plans to get another proposal later to cover the rest of Ward 3.

    Motion made by Alderman Cody, seconded by Alderman Gill and unanimously carried to approve the Mississippi Power proposal for first phase of the outdoor LED lighting conversion in Ward 3. (Exhibit 4-b)

    OLD BUSINESS and ADDENDUM

    The Mayor stated there was going to be a presentation on the GeoTour with the GeoCache Program that was approved by the Board but had to pull due to continued discussions about the contract with the GeoTour GeoCache.com.  The City Attorney has had several discussions with them about some liability issues.  The Mayor hopes to have additional information to present at the Recess Meeting on Tuesday, April 18, 2017.

    Motion made by Alderman Cox, seconded by Alderman Cody and unanimously carried to approve clarification of Buffer Review for Non-Objection Requirement of Ordinance 2017-03 Provisions for a Bed & Breakfast Enterprise in R-1 Zone after Public Hearing. (Exhibit 5-a)

    Motion made by Alderman Impey, seconded by Alderman Cox and unanimously carried to authorize lifting the moratorium for Bed & Breakfast Applications in conjunction with the established effective date of the new ordinance which is April 21, 2017. (Exhibit 5-b)

    PUBLIC COMMENT

    John Rodriguez, 8801 Dixie Street, discussed a water situation in his area.  Mr. Rodriguez stated there was a community well that was servicing several neighbors broke.  The neighbor to this property added these neighbor to his well, not a community well, and has since passed away.  The new owners of the property have shut the water off leaving his property along with (3) three other properties with no water.  Mr. Rodriguez said there is a 6” water line that was run down Lee Street and is asking the City of Ocean Springs to provide water since the lines are there and available.  Mr. Rodrigues’s property is outside of city limits.  The Mayor told Mr. Rodriguez she would get with the Interim Public Works Director about this issue and look at some options.

    CONSENT AGENDA and ADDENDUM

    Motion was made by Alderman Gill, seconded by Alderman Impey and unanimously carried to approve the Consent Agenda with the exception of Item (7-g) pulled by Alderman Cox.

    Alderman Cox asked for a clarification on the figures mentioned in the Item (7-g) memorandum.  The Planning and Grants Administrator stated the contract price did not drop.  The loan amount was to cover the engineering and the contractor.  The only amount we are adjusting is the contractor’s amount.

    None.

    ALDERMEN’S FORUM

    Alderman Gill is requesting a street light be placed at the Corner of King Henry and Princess Anne in Fort Bayou Estates.

    Alderman Gill asked about getting the grass cut on the corner of Parliament and Sussex Streets.  The Building Official asked to revisit this at the next Board meeting because it has already been posted at City Hall and advertised in the newspaper but he needs to have a 15 (fifteen) day threshold.

    Alderman Cody thanked the Interim Public Works Director for (2) two projects he helped him with.  Alderman Cody also thanked the Building Official and the City Electrician for the work they are doing to correct the electrical problems at the Mary C. O’Keefe Arts and Cultural Building.

    The Mayor and Alderman Gill discussed homeowner associations taking over some of the landscaping projects at subdivision entrances to alleviate some labor and budget constraints on Public Works.        

    Alderman Cox asked for an update on the railroad crossing at Thorne Avenue.  The Interim Public Works Director stated they have reached out to CSX again but has not received a response at this time.  The Mayor stated there is going to be a survey of every single crossing on the Coast.  Alderman Cox said he is concerned with the width of the insert in between because a trailer has gone off of it and damaged some equipment. 

    Alderman Impey wanted to give a kudos to Public Works for their 5 star on their water rating and asked the Mayor if she has done a press release on that.  The Mayor will get with the Assistant Public Works Administrator and get a press release out.

    Alderman Impey asked if the Board could make a decision on the date for the fireworks display so the Director of Parks and Leisure Services can get it scheduled. 

    Motion was made by Alderman Cody, seconded by Alderman Gill and unanimously carried to schedule the fireworks display for Monday, July 3rd, 2017.

    Alderman Impey reminded everyone that the Easter Egg Hunt is scheduled for Saturday, April 8, 2017 from 9:00 a.m. – 12:00 p.m.

    Alderman Impey recognized the Mayor, Alderman Cody, Alderman Cox, and himself for participating in the Bicentennial Celebration.  Alderman Impey recognized Colonel Farragut and his Junior ROTC Color Guard from Ocean Springs High School and the great job they did.  Alderman Impey said he was approached by George Schlogal who wanted to tell him that this was as much of an Ocean Springs success as it was for Gulfport due to Cynthia Sutton and her staff from the Ocean Springs Chamber of Commerce.

    Alderman Impey said the Victorian Preservation Society of America gives out (2) two annual preservation awards every year.  This year one award will be presented for the restoration and preservation of the U.S. Capitol dome and the other will be for the restoration and preservation of the Charnley-Norwood House in Ocean Springs, Mississippi.   

    The Mayor reminded everyone the Garden Club Spring Pilgrimage will be on Monday, April 10th and the Charnley-Norwood House will be on the tour.

    The Interim Public Works Director wanted to publically thank the City Clerk and her staff for all of the hard work they do to help gather information in order to maintain the 5 star water rating.

    The Mayor gave an update on the trash receptacles.  The Purchasing Agent met with our new representative from Mississippi Prison Industries and discussed the issues with the sign area and rust on the receptacles.  The Purchasing Agent is waiting on additional information on the cost to send the receptacles back and have the sign areas removed.

    The Mayor presented a design for the placard for the receptacles.  It will be flexible aluminum, with rounded edges, and 18” x 24” in size. 

    Motion was made by Alderman Gill, seconded by Alderman Cox to authorize the Mayor to place the order for the placards with the reflective background to go on the receptacles to be placed in the Arts & Entertainment District.  Aldermen Gill, Cox, and Cody voted aye.  Alderman Impey voted nay.  Motion passed.

    EXECUTIVE SESSION

    Motion made by Alderman Gill, seconded by Alderman Cody and unanimously carried to enter into closed session to determine the necessity of remaining in executive session.

    The City Clerk returned to the meeting and announced a motion was made by Alderman Cody, seconded by Alderman Gill and unanimously carried to remain in executive session to discuss potential litigation regarding inmate labor at Public Works.

    Motion was made by Alderman Cox, seconded by Alderman Cody and unanimously carried to return to regular session. 

    Motion was made by Alderman Cody, seconded by Alderman Impey and unanimously carried to direct the Mayor to meet with Mississippi Department of Corrections about reestablishing the inmate program.

    Motion was made by Alderman Cody, seconded by Alderman Impey and unanimously carried to direct the Mayor to meet with Department Heads regarding communications with outside entities.

    Motion was made by Alderman Cody, seconded by Alderman Impey and unanimously carried to recess the meeting until April 18, 2017 at 6:00 p.m.  

    Meeting ended at 7:30 p.m.
